5. Filing a DMCA Notice

A valid copyright infringement notice should include the following:

  • Notify the user or client responsible for the content;
  • Request additional documentation if necessary; and
  • Take other actions required or permitted by applicable law.

Submission of a DMCA Notice does not automatically establish that infringement has occurred.

7. Counter-Notification

If you believe that your content was removed or disabled in error or as a result of mistaken identification, you may submit a written Counter-Notification.

A valid Counter-Notification should include:

  • Your name, address, telephone number, and email address;
  • Identification of the material removed or disabled and its previous location;
  • A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification;
  • A statement consenting to the jurisdiction of the appropriate federal court if required under the DMCA;
  • Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we may restore the removed material unless the original complainant files a court action within the time allowed by law.

8. Repeat Infringer Policy

Wordsmith Media Solutions maintains a policy of terminating or restricting access for clients, users, or account holders who repeatedly infringe the intellectual property rights of others.

We reserve the right to suspend projects, remove content, terminate service agreements, or permanently refuse service to repeat infringers.
